‘Weird dance’ before sex attack on boy: court 

A 46-year-old social media influencer accused of sexually assaulting a 14-year-old told him in a lawfully tapped phone call she was “deluded” at the time of the alleged act and thought they were both 18, a court has heard.

The woman, who cannot be named for legal reasons, has pleaded not guilty to two counts of aggravated sexual intercourse with a child under 16 years old.

On Monday, the NSW District Court was shown a video of her dancing in front of the teen just hours before she climbed into bed with him on an evening in mid-2021.

The woman is wearing patterned blue tights and a black top and looking directly at the camera as she sways to the music and flips her hair.

The court heard the 14-year-old was holding the camera for what he later described as the “weird sexual” dance.

The influencer can be seen turning away from the camera and rubbing circles on her bum with her hand before twerking while looking back at the teen.

When asked by crown prosecutor Emma Blizard whether she was dancing in a sexual manner, the influencer replied “most dancing is sexual” and her dancing was “just like any Beyonce video clip”.

She told the jury the video was “extremely embarrassing” and she felt “very betrayed” months later when she found it.

The court heard she’d consumed up to one and a half bottles of wine and was “very down” when she climbed into bed with the teen two hours later.

The influencer said the teen initiated a “broken” kiss which she said “wasn’t non-stop French kissing” and “rolled on top” of her.

The 46-year-old is accused of undressing the teen and engaging in oral and penetrative sex with him, but she maintains she ended the “awkward” kiss and left.

In a phone call recorded by police in July 2022, the woman told the teen she felt “really close” to him.

“I started loving you so much (that) I got it confused, like, I started getting attracted to you,” the woman said before laughing in the call played in court.

However, she clarified in court she had been “mentally and emotionally attracted” to the “kind” and “attentive” 14-year-old but had never been physically attracted to him.

The woman told the court she “categorically” denied ever being attracted to any young teenage boy as an adult.

“When it turned physical, that’s when I felt it was very awkward and wrong,” the woman told the jury.

“That’s why I ended it.”

In the tapped phone call, the influencer told the teen she had been “deluded” when they kissed.

“I thought you were 18 and I was 18,” she said to him.

Her lawyer Phillip Boulten SC asked her what she meant when she told the teen she was attracted to him and felt they were the same age.

“I was rationalising a very irrational moment,” she responded.

Under cross examination, the 46-year-old conceded she had not been entirely truthful during the tapped phone call with her alleged victim.

She said she was “ashamed of the kiss” and she was trying to pacify the teen so he wouldn’t report his “false accusation”.

“I wanted to move on because I didn’t want any trouble,” she said.

“I made a mistake and so did he.”

The court also heard the influencer told the 14-year-old boy he was “a man now” during the lawfully intercepted call.

“You’re not a boy, you’re obviously a man,” she said.

When the teen asked her about the night they kissed, the 46-year-old told him she had “a serious alcohol problem” at the time and “used to have blackouts”.

However, she told the court she had never lost her memory of an event entirely.

The woman said she was drunk and “foggy” when she approached the teen on the night in mid-2021.

“I wasn’t highly intoxicated but my brain was definitely affected,” she told the court.

“Otherwise I would never have done anything like (the kiss). I can’t even relate to it, to this day.”

The court heard she cited that night as one of the reasons she decided to quit drinking months later.

The influencer disagreed with Ms Blizard’s suggestion the event had been “so significant” because she “knew what happened was more than kissing”.

“I did something wrong and that’s one of the reasons I stopped drinking,” she said.

Three of her friends testified they were “shocked” when they learned about the allegations, which one labelled “utterly inconceivable” and “completely out of character”.

“I thought someone made it up,” another friend told the jury of eight men and four women.

The 46-year-old was described as a “kind” and “good person” who the witnesses trusted with their children.

However, two of the friends noted they had not ever seen her drunk and conceded they didn’t know how she behaved when she was highly intoxicated.

The trial will continue on Tuesday before Judge Sarah Hopkins.
